Terms of Use
§ 1 Scope
These Terms of Use govern the use of the online tools and self-service functions provided by bytebrise (Js Serfözö, Balduin-Helm-Straße 71b, 82256 Fürstenfeldbruck). In addition, the General Terms and Conditions (AGB), which govern contracts for web design and maintenance services, and the Privacy Policy apply.
This covers in particular: the customer portal at crm.bytebrise.com/customer-portal.php, the referral programme, the optional AI add-ons (Humanize, AI Copywriter), the free audit tool (free-audit.php) and the Stripe-based self-service payment processes.
In the event of any conflict between these Terms of Use and the General Terms and Conditions, the General Terms and Conditions take precedence where the main services (website creation, maintenance, consulting) are concerned. These terms apply to the use of the tools.
§ 2 Account and access (magic link authentication)
Access to the customer portal is exclusively via a one-time login link sent to the email address stored in our CRM (a so-called magic link). The link is valid for 30 minutes and can be used once. No password is stored.
The user is obliged not to pass on the magic link and to keep their email address protected by customary measures (their own password, two-factor authentication with their email provider). bytebrise is not liable for damage resulting from the user passing on the magic link.
A session in the customer portal ends automatically after 24 hours at the latest. Logging in again requires a new magic link.
§ 3 Functions provided
3.1 Customer portal
The following functions are available in the customer portal:
- Status display of your own website (availability, latest updates).
- Change requests with priority selection (low / normal / urgent).
- Testimonial submission for publication on the bytebrise references page (after approval by the user).
- Invoice and contract overview linked to Stripe.
- Tier change (upgrade or downgrade of the maintenance tier).
- Account details (billing email, address, VAT ID).
- Cancellation flow with exit survey (see § 6).
- Right to be forgotten (Art. 17 GDPR): erasure request at the push of a button.
- NPS feedback: occasional short satisfaction survey.
- Referral programme with a personal referral link (see § 5).
3.2 Free website audit
At crm.bytebrise.com/free-audit.php, anyone, including people without a customer relationship, can have their own website checked for performance, SEO, accessibility and legal compliance. The URL entered and (optionally) the email address are processed for the evaluation. If an email address is entered, a non-binding lead entry is created in the CRM; we only make contact if the user expressly agrees to this or contacts us themselves.
3.3 AI add-ons (optional, subject to a charge)
AI-powered tools such as the Humanize package (reducing traces of AI in your own texts) and the AI Copywriter (blog post generation) can be booked as optional extras. These add-ons are billed as a monthly subscription via Stripe.
Important notes on AI tools:
- Generated content must be checked by the user before it is used publicly. bytebrise gives no guarantee for factual accuracy, currency or legal soundness (e.g. health claims, misleading advertising, copyright).
- The intellectual property in the material entered by the user remains with the user. The user may freely use the result of the AI processing; as a rule, purely machine-generated output does not create an independent work within the meaning of copyright law.
- The AI models used (e.g. Anthropic Claude) process the input in accordance with the respective provider's terms. bytebrise selects models so that no input is used for training (API zero retention where supported).
- Input must not contain third-party secrets, applicants' CVs, patient or client data or other particularly sensitive content unless there is an appropriate legal basis.
§ 4 Obligations of use and prohibited use
The user undertakes to use the tools only for their intended purpose. The following is prohibited in particular:
- attempting to bypass security mechanisms, sending automated mass requests or circumventing rate limits;
- using the audit tool to probe third-party systems for vulnerabilities without the express authorisation of the respective owner;
- feeding unlawful, offensive, discriminatory or illegal content into AI add-ons;
- publishing staged, fictitious or infringing testimonials.
bytebrise reserves the right to block access or terminate the contract without notice in the event of violations. Existing payment obligations under the main contract remain unaffected.
§ 5 Referral programme
Active customers with an ongoing maintenance contract can create a personal referral link via the customer portal. If a referred person signs a maintenance contract with bytebrise within 30 days of clicking the referral link, the referrer receives one month of maintenance free of charge as a credit on their own contract.
Conditions:
- At the time of the conversion, the referrer must be an active bytebrise customer (ongoing maintenance contract that has not been cancelled).
- Self-referrals, referrals to companies affiliated with the referrer and referrals to existing bytebrise customers are excluded.
- The credit is issued as a Stripe coupon on the next invoice. A cash payout or offsetting against other services is not possible.
- Exactly one credit is granted per conversion, even if the referred person signs several contracts.
- bytebrise may change or end the programme at any time with 4 weeks' notice. Claims arising up to that point remain unaffected.
§ 6 Cancellation, tier change and annual pre-pay
6.1 Standard cancellation
Cancellation of the maintenance contract is governed by the General Terms and Conditions. The cancellation flow can be started via the customer portal; it is processed at the earliest possible end of the contract.
6.2 Tier change
Upgrades or downgrades of the maintenance tier take effect from the next billing period. Amounts already paid are offset pro rata (Stripe proration).
6.3 Annual pre-pay
Optionally, the maintenance contract can be paid annually in advance. Pre-payment is voluntary; in return, a fixed discount of 7% applies (coupon ANNUAL_PREPAY_7PCT). Example at €149 per month: 12 × €149 = €1,788.00, less 7% = €1,662.84 (€138.57 per month). In the event of early cancellation within the paid period, bytebrise refunds €138.57 for each unused full month (from the month following the end of the contract) plus the pro rata amount, calculated to the day, for the rest of the month already begun. § 5.3 of the General Terms and Conditions is authoritative.
§ 7 Availability and maintenance
bytebrise strives for the highest possible availability of all tools and customer sites. A specific level of availability (uptime SLA) is not owed in the standard tier; it will be explicitly agreed in Pro and Enterprise tiers as soon as these tiers are available.
Planned maintenance windows are announced at least 48 hours in advance wherever possible. Security-critical updates may require immediate maintenance without prior notice.
The status of running services can be seen in the customer portal.
§ 8 Liability
bytebrise is liable without limitation for intent and gross negligence. In the case of simple negligence, liability is limited to damage arising from the breach of essential contractual obligations (cardinal obligations) and to the foreseeable damage typical for the contract.
Liability for content or recommendations generated by AI add-ons is limited to the availability of the tool. The user is responsible for the factual accuracy and lawful use of the generated content (see § 3.3).
Liability under the German Product Liability Act (Produkthaftungsgesetz) and for damage resulting from injury to life, body or health remains unaffected.
§ 9 Data protection
Which personal data are processed and on what legal basis is described in the Privacy Policy. Where bytebrise processes data on behalf of the customer as part of the tools (e.g. content of the customer site), the Data Processing Agreement (AVV) also applies.
§ 10 Changes to these Terms of Use
bytebrise may amend these Terms of Use when new functions become available or legal requirements make this necessary. Users with an active contract will be notified of material changes by email at least 4 weeks before they take effect. If the user does not object to the change within this period, the change is deemed accepted. The right to object and its consequences will be pointed out separately in the change notification.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Fürstenfeldbruck.
Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.
